Abstract: Hu Jintao's report at 18th Party Congress has stated the strategic position of agricultural modernization. The key of agricultural modernization is agricultural technology innovation, but which can't do without legal institutional arrangement. Even China's agricultural S&T legal system has achieved great progress, it still has many problems and needs to be further developed. According to these problems, this paper gives some policy suggestions for the improvement direction of  agricultural  S&T legal system .
